1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms.

2. Description of Service

opchat is a multi-provider AI chat application that allows you to connect your own API keys to various AI providers and create custom AI personas. The App stores data locally on your device.

3. API Keys and Third-Party Providers

• You are responsible for obtaining and maintaining valid API keys from third-party AI providers.
• You must comply with each provider's terms of service:

  • Microsoft (Azure): https://www.microsoft.com/licensing/terms
• INSCODE is not responsible for provider availability, pricing changes, rate limits, or content policies.
• You are solely responsible for any charges incurred through your use of third-party API keys.

4. AI-Generated Content

Artificial intelligence can and does make mistakes. All responses displayed in the App are generated entirely by third-party AI models, not by INSCODE. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, misleading, biased, or entirely fabricated ("hallucinations"). INSCODE has no ability to verify, filter, or correct AI outputs before they are displayed to you.
• INSCODE does not control, endorse, or guarantee the accuracy, completeness, reliability, or appropriateness of any AI-generated content.
• INSCODE accepts no responsibility or liability whatsoever for any consequences, damages, losses, or harm — whether direct, indirect, incidental, or consequential — arising from your use of, or reliance on, AI-generated content.
• You use AI-generated content entirely at your own risk. You are solely responsible for evaluating and verifying any AI output before acting on it.
• AI-generated content is not a substitute for professional advice. Do not rely on AI outputs for medical, legal, financial, tax, safety, or any other professional guidance. Always consult a qualified professional for such matters.
• You are solely responsible for any decisions, actions, or consequences that result from your use of AI-generated content.

5. User Content

You retain all rights to content you create within the App, including conversations, personas, and project configurations. You are solely responsible for the content you create and share.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to abuse, harass, or generate harmful content via AI providers
• Violate the terms of service of any connected AI provider
• Attempt to gain unauthorized access to the App's systems

7. Intellectual Property

The App, including its design, code, graphics, and logo, is the property of INSCODE. The opchat name and logo are trademarks of INSCODE.

8. Third-Party Services

The App integrates with:

• AI providers (as listed in section 3)
• Firebase & Amplitude (analytics) — see Privacy Policy
• Serper.dev & Tavily (web search)
• Model Context Protocol (MCP) servers as configured by user

We are not responsible for the practices or content of third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, RELIABILITY, OR CORRECTNESS OF ANY AI-GENERATED CONTENT, TOOL OUTPUTS, OR DATA OBTAINED THROUGH THE APP.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSCODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of, or inability to use, the App;
• Any AI-generated content, including but not limited to inaccurate, misleading, harmful, or fabricated outputs;
• Any actions taken or decisions made based on AI-generated content;
• Any third-party AI provider service disruptions, errors, or content policy changes;
• Loss of locally stored data due to device malfunction, uninstallation, or any other cause;
• Any unauthorized access to or alteration of your API keys or data.

11. Indemnification

You agree to indemnify, defend, and hold harmless INSCODE, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your use of or reliance on AI-generated content; (c) any content you create, share, or transmit through the App; (d) your violation of these Terms; or (e) your violation of any third-party rights, including AI provider terms of service.

12. Modifications

We reserve the right to modify or discontinue the App at any time without notice.

13. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Republic of Poland.
